Volusia County is located in the east-central part of Florida between the St. Johns River and the Atlantic Ocean. The county has 553,543 citizens living there. The county seat is DeLand. Volusia County is part of the Deltona-Daytona beach-Osmond Beach metropolitan statistics area as well as the Orland-Deltona-Daytona Beach combined statistical area. Volusia County Florida is fifty miles northeast of Orlando, and just north of the Kennedy Space Center.
The County is divided into three regions. These regions are East Volusia or the greater Daytona Beach area, Southeast Volusia known as the greater New Smyrna Beach area, and West Volusia also called St. Johns River County.

The government of the County is a council-manager form and voters elect a county council that has seven members serving four-year terms. Five are elected by district and the county chairman is elected countywide. The county council establishes ordinances and policies plus reviews and approves the county budget. The council appoints a county manager who handles day-to-day business.

Courthouse

The main courthouse contains four floors and is located at The Thomas C. Kelly Administration Center 123 W. Indiana Ave. DeLand, FL 32720. Included in this building are court facilities, State Attorney, Public Defender, Sheriff’s Judicial and Community Services, Clerk of the Circuit Court, and Records Management.
The Volusia County Courthouse opened in 2001. The building is made of precast concrete with a brick façade. The building has a clock tower with a seal of Lady Justice.
The Old County Courthouse is home to Central Florida history and also holds some county offices. It was constructed in 1929. This structure is listed on the National Registry of Historic Places in downtown DeLand.

County Clerk

Laura E. Roth is the Clerk of the Circuit Court in Volusia County. This position is an elected office whose responsibilities include recording and maintaining the official records of Volusia County and serves the County and Circuit Courts as the one responsible for the official court records.

The Clerk’s duties also include recording property transactions, attending all court proceedings, maintaining official court records, and providing access to those records as permitted by law. She assists victims of domestic abuse, processes child support payments, collects court fees and fines, administers court-ordered sales, and processes marriage and passport applications. The clerk and her staff must efficiently handle and manage millions of public records plus millions of dollars of public money.

District Court

District Courts of Appeal are divided into six appellate districts and six District Courts of Appeal. These courts review cases appealed from the circuit and county courts. Judges are appointed by the governor and anticipate in merit attention elections every six years. Appeals from the Seventh Judicial Circuit Court are viewed and decided by the Fifth District Court of Appeals located in Daytona Beach, Florida. The Chief Judge who presides over the Seventh Judicial Circuit including Circuit and County Courts is Lea R. Case.

The District Court hears cases involving criminal cases that involve misdemeanors and infractions that are non-jury. It also hears juvenile cases for juveniles that are under age 16. These cases involve delinquencies, and the juvenile court has the authority to hear juvenile undisciplined cases under the age of 18. It also considers abuse, neglect, and dependency cases involving children younger than 18.

Circuit Court

The Seventh Judicial Circuit Court of Florida has jurisdiction over Flagler, Putnam, St. Johns, and Volusia Counties. Each court is divided into 20 Judicial Circuits or areas of jurisdiction. Circuit courts are composed of Circuit and County Courts. The Courts are legally and constitutionally to protect rights and liberties, hold and interpret the law, and provide for the peaceful resolution of disputes.

District Court Services are appeals from county court, civil cases, family law matters, felonies, guardianship matters, juvenile delinquency, juvenile dependency, mental health, and probate. 27 circuit judges in District court preside in courthouses across the circuit. The services of retired judges, General Magistrates, Child Support Hearing Officers, and Civil Traffic Hearing officers are also available to aid in the disposition of cases.

County Court

The County Court’s responsibilities are to certify questions and handle civil cases, misdemeanors, small claims, and traffic court. The county court has 17 County Court Judges who are also spread throughout the circuit. The County Court Judge is Katherine Hurst Miller.

Superior or Magistrate Court

Superior Court for Volusia County is in the 7th Judicial Circuit of Florida. 44 judges hear cases in the Seventh Judicial Circuit. Twenty-seen judges are at the circuit level and 17 in county courts.

Civil Court

Civil cases include magistrates who are authorized to try small claims cases of $10,000 or less, landlord eviction cases, suits for recovery of personal property, and motor vehicle mechanics’ liens. In criminal cases, a magistrate is authorized to issue warrants for arrest, set bail, accept guilty pleas for minor misdemeanors and infractions, and accept trial waivers for certain worthless check cases.

Drug Felony Court

Florida Drug courts in Volusia County are designed to assist chemically dependent offenders with court-ordered treatment plans.
Recovery Court handles those individuals who are chemically dependent in adult court, juvenile, abuse, neglect, and dependency cases. Recovery Court also serves veterans and people with mental health issues who find themselves in court for criminal activities. The program offers individualized treatment plans including counseling, supervision, drug testing, sanctions, and incentives for meeting recovery goals.

Specialty drug courts include a family drug treatment court that works with parents and guardians who are in danger of losing custody of their children due to abuse or neglect charges. Adult drug treatment court helps to ensure offenders who are addicted to drugs and alcohol receive treatment to become law-abiding, productive, and healthy community members, and youth drug treatment court focuses on juvenile delinquency matters and status offenses that involve substance-using youth.
